This Privacy Policy (“Policy”) describes how Gloss Up (“the App”), operated by With Bytes LLC (“Company,” “we,” “us,” or “our”), collects, uses, discloses, and safeguards the personal information you provide when you use the App and any related services (collectively, “Services”). By using our Services, you agree to the collection and use of your information in accordance with this Policy. If you do not agree with our practices, please do not use our Services.

1. Information We Collect

a. Personal Information: We may collect personal information that you choose to provide to us, including but not limited to your email address if you sign up for an account or subscribe to our marketing communications.

b. Images and AI Processing: When you upload a photo of your face to the App, we process it through our AI models to show you an image with makeup effects. We do not claim ownership of the images you upload; however, by uploading images, you grant us the necessary rights to process them for the purpose of providing our Services. We reserve the right to temporarily store or transmit these images to our service providers solely to deliver the requested service. We do not intentionally collect any biometric identifiers beyond facial images provided, nor do we use facial images for any purpose other than those stated in this Policy.

c. Usage Data: We may automatically collect information about your usage of the App, including your IP address, device information, operating system, browser type, referring URLs, and actions taken while using our Services.

2. How We Use Your Information

a. Service Delivery: We use your information to provide and improve our Services, including processing your uploaded photos with AI models, displaying makeup recommendations, and providing product links.

b. Marketing Communications: If you sign up with your email, you will be automatically enrolled to receive marketing and promotional communications from us. You can opt out at any time by following the unsubscribe link in any email we send.

c. Customer Support: We may use your information to respond to your inquiries, troubleshoot issues, and provide technical support.

d. Analytics and Improvements: We may use usage data to analyze how users interact with our App, improve our AI models, and enhance user experience.

e. Legal Compliance: We may use or disclose your information where we believe it is necessary to comply with any applicable law, regulation, legal process, or governmental request.

3. Disclosure of Your Information

a. Service Providers: We may share your information with trusted third-party service providers who perform services on our behalf, such as cloud hosting, image processing, data analytics, email marketing, and customer support. These third parties are authorized to use your personal information only as necessary to provide these services to us.

b. Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, or protect the personal safety of users or the public.

c. Business Transfers: If we are involved in a merger, acquisition, or asset sale, your personal information may be transferred as part of that transaction. We will provide notice on our website if such a transfer occurs and becomes subject to a different Privacy Policy.

4. Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. We do not retain face data indefinitely. Please see Section 11 for specific information regarding how and why we collect, store, and retain face data, including our maximum retention period. We may retain aggregated or de-identified information for research or analytics purposes.

5. Security of Your Information

We implement commercially reasonable security measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

6. Children’s Privacy

Our Services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we might have any information from or about a child under 13, please contact us immediately, and we will promptly delete it.

7. International Data Transfers

Our Services are primarily operated in the United States. If you are located outside the United States, your information may be transferred to, stored, and processed by us and our service providers in jurisdictions that may have data protection laws different from those of your country.

8. Your Rights and Choices

You may have rights regarding your personal information, such as the right to access, correct, or request deletion of your personal data. You can also opt out of receiving marketing emails by clicking the “unsubscribe” link at the bottom of any marketing email.

9. Changes to This Privacy Policy

We reserve the right to update or modify this Policy at any time. If we make material changes, we will provide notice (e.g., by email or through the App). Your continued use of the App following any updates constitutes your acceptance of the revised Policy.

11. Face Data

Collection and Purpose. We collect user-provided photographs that may contain a face (“Face Photos”) in order to apply makeup or beauty filters. We pass these Face Photos to a third-party API solely to apply your requested filter effect. We do not use Face Photos for AI training, identification, or any other purpose beyond providing the requested filter.

Storage and Retention. We store your Face Photos on servers hosted by Google for the purpose of allowing you to sync and access your photos across multiple devices. We do not retain Face Photos indefinitely. If you do not delete your Face Photos or deactivate your account, they will remain on our servers for up to two (2) years of account inactivity. After two (2) years of inactivity, we automatically delete stored Face Photos. You may also delete them at any time by removing the photos within the App or deleting your account, which permanently removes them from our servers.

Third-Party Sharing. We share Face Photos only with our third-party filter provider to apply the requested visual effect. This third-party provider processes your Face Photos in real time and does not store them. We do not share or sell your Face Photos to any other parties.

Reason for Sharing. We share your Face Photos solely so you can receive the beauty or makeup filter you request. This sharing is necessary to provide the Services and does not allow the third party to use or retain your Face Photos for any other purpose.

No Third-Party Retention. Our third-party filter provider does not store Face Photos after applying the filter effect. They process these images only as needed to fulfill your request.
